Internet access at the holiday home Ca Piero - connection and usage agreement

IMPORTANT INFORMATION ON INTERNET USAGE

Scope of Service
We, the landlord of the holiday home Ca Piero, provide internet access services to our guests on holidays. The
service is available 24/7 and is free-of-charge. There is neither a legal right to this service nor specific services
and data transfer rates. This service is to provide the holidaymakers the opportunity to access information, such
as personal e-mails with their notebooks or one made available to them, to chat with their folks back home or surf
with normal data usage. Legally, this Agreement will apply to all guests who have access to this network.

Scope of Use
With the form, content or intended purpose of his/ her Internet use, the guest may not violate legal
prohibitions, morals and rights of third parties (name, copyrights, privacy rights, etc.). The guest
undertakes, in particular, not to:
- display any copyright protected, pornographic, violent or racist contents, make them publicly available or
distribute them,
- call for criminal activities or provide instructions for this. The same applies to sending e-mails or other
messages,
- send or save data that, by their nature or property (e.g. viruses), size or reproduction (e.g. spamming),
would be likely to endanger the existence or operation of the website or other Internet users. The guest
avoids data traffic with continuous load and high traffic (web hosting, file sharing, video streaming, etc.)
and does not provide any Internet services to third parties,
- download data from the Internet that violate licence and copyright or applicable law. These include
illegal music, video, software and similar downloads,
- download data from the internet that give rise to additional costs for the landlord.
Use is only allowed for direct guests on vacation at the holiday home of Ca Piero. If any third party gains
access to the network of the landlord due to the fault of the guest, the same shall be liable in the case of
damage.
Internet use is restricted by a password. This is only handed over to guests of the holiday home who
accept this User Agreement. The disclosure of the password to any third party or the provision of access
and/or dial-up points (physically and/or using software) to third parties is not permitted.

Self-protection
The landlord points out that the guest shall be responsible for sufficient protection of his/ her own
terminal device against malicious programs (viruses) or intrusion attempts (hacking) from the Internet
and for securing his/ her data. The guest shall solely bear any risk to his/ her data, hardware and
software
that may arise from the use of the landlord's Internet access . The guest will ensure compliance with the
licence requirements for all programs installed on his/ her terminal device and their intended use. By
appropriate measures (e.g. password at the operating system level), the guest ensures that sensitive data
on his/ her device is protected from unauthorised access. The guest is responsible for the proper
configuration of his/ her terminal device.

Warranty
The landlord does not assume any responsibility for the actual availability of Internet access. Each
guest is responsible for the security of his/ her own terminal device. Any prosecution of the landlord for
damage arising from the use of the network is excluded, in general.

Connection data storage/ data protection
The landlord is obliged by law to store connection data according to Telecommunications Act. Date/ time
for the beginning and end of the guest Internet session are stored.
The landlord collects, processes and uses personal data of the guest only insofar as they are required for
contractual reasons and execution, as well as for accounting and statutory compliance purposes. The
guest herewith agrees to the storage of this data.
The landlord expressly points out to the guest that the protection and security of his/ her data transmitted
in public networks during Internet use and the terminal device used cannot be guaranteed according to
the current state of the art, unless the guest takes appropriate measures.

Exemption
If the guest or his/ her e-mail traffic violates the mentioned prohibitions, the morals or third party rights,
and the VP is responsible for this, the guest is liable to the landlord for compensation of any damages
incurred.
The guest shall pay the landlord all damages arising out of any breach of the foregoing provisions, insofar
as he/ she is responsible for this. The compensation also covers the reasonable
costs of any legal defence.
The landlord informs the guest immediately, if he or a third party makes official claims and gives the
guest the opportunity to make a statement.

This agreement is valid for the duration of the stay and comes into effect as soon as the guest connects to the accommodation's Wi-Fi.
